color: #000000;">第一条 </span></strong><span style="font-size: 17px; color: #000000;">为调动全社会力量参与城市管理，巩固全国文明城市创建成果，营造整洁、优美、文明的城市环境，建立健全城市管理长效机制，根据《邯郸市城市市容和环境卫生条例》等相关法规规章，结合我市实际，制定本办法。</span></p><p> </p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong><span style="font-size: 17px; color: #000000;">第二条</span></strong><span style="font-size: 17px; color: #000000;"> 本办法适用于邯郸市丛台区、复兴区、邯山区、邯郸经济技术开发区。</span></p><p> </p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong><span style="font-size: 17px; color: #000000;">第三条</span></strong><span style="font-size: 17px; color: #000000;"> 本办法所称的“门前五包”责任制是指临街机关、团体、学校、企事业单位、个体工商户等对其住所地、经营场所地划定的责任区，承担卫生、市容、秩序、绿化、管护的相应责任。</span></p><p> </p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong><span style="font-size: 17px; color: #000000;">第四条</span></strong><span style="font-size: 17px; color: #000000;"> 责任区范围横向为建（构）筑物、居民房沿路的总长，相邻单位有空档的以二分之一间距为界；纵向为建（构）筑物、居民房（包括围墙）的墙基至道路的路沿石，无路沿石的至机动车道边缘。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">“门前五包”责任区内有经批准的集贸市场、停车场等设施的，由其管理单位或经营者按照批准的范围，承担相应的管理责任。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">店面房出租的，“门前五包”责任由承租方承担，但出租方有责任检查督促承租方履行“门前五包”责任制。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong><span style="font-size: 17px; color: #000000;">第五条</span></strong><span style="font-size: 17px; color: #000000;"> 市城管执法部门是城市“门前五包”责任制工作的主管部门，负责对全市“门前五包”责任制工作监督、协调、考评和指导。区综合行政执法部门负责“门前五包”责任制工作的组织实施和监督检查。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">各街道办事处（乡镇政府）负责本辖区内“门前五包”责任制工作的具体实施、日常管理和检查落实。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">各级公安机关交通管理部门按照相关职责，落实“门前五包”责任制的有关工作。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong><span style="font-size: 17px; color: #000000;">第六条</span></strong><span style="font-size: 17px; color: #000000;"> “门前五包”责任制实行市、区、街道办事处（乡镇政府）“条块结合、以块为主”的原则。</span></p><p> </p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong><span style="font-size: 17px; color: #000000;">第七条</span></strong><span style="font-size: 17px; color: #000000;"> “门前五包”责任制的责任主体应当规范自身行为，履行下列责任:</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">（一）包卫生。保持责任区环境卫生整洁，无果皮纸屑、无乱倒垃圾、无污水污物、无粪便、无污迹、无渣土等；严禁将污水倒入街路雨水收水口；雪后及时清除责任区内积雪、积冰。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">（二）包市容。保持责任区市容整洁，无擅自占道经营、乱搭建、乱张贴、乱涂写、乱刻画、乱吊挂、乱堆放等现象。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">（三）包秩序。不在责任区内擅自摆摊设点、乱停车辆，不得违规设置宣传条幅、落地式灯箱。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">（四）包绿化。不向责任区绿地内堆放杂物、焚烧物品、排放污水或者倾倒有毒有害物质，不践踏绿地、损伤树木花草。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">（五）包管护。不得故意破坏毁损门前市政公用设施。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em;">发现上述相关违法行为，责任主体可依法制止或向12345政务服务便民热线举报。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em;"><span style="font-size: 17px;">第八条</span></strong><span style="text-indent: 2em; font-size: 17px;"> 实行“门前五包”承诺书制度。承诺书内容和式样由全市统一规范。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">各区组织街道办事处（乡镇政府）或综合行政执法部门与责任主体签订“门前五包”承诺书，承诺书张贴于责任区内显要位置。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">“门前五包”责任主体变更的，应当自变更之日起30日内重新签订“门前五包”承诺书。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; caret-color: transparent;"><span style="font-size: 17px;">第九条</span></strong><span style="caret-color: transparent; text-indent: 2em; font-size: 17px;"> “门前五包”的方式。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">（一）临街机关、团体、学校、企事业单位</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">上述单位与所在街道办事处（乡镇政府）签订“门前五包”承诺书，在其单位门口张贴由市统一制作的“门前五包”责任牌，明确“五包”内容、范围及具体负责人员，执行下列规定：</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">1.明确一名单位负责同志分管“门前五包”工作；</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">2.建立健全各项管理规章制度，“门前五包”实行定人、定岗、定责；</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">3.接受“门前五包”责任制主管部门和街道办事处（乡镇政府）的监督检查。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">（二）临街门店</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><span style="font-size: 17px; text-indent: 2em; caret-color: transparent;">临街门店与街道办事处（乡镇政府）或区综合行政执法部门签订“门前五包”承诺书。在其门口张贴由市统一制作的“门前五包”责任牌，明确“五包”内容、范围及具体负责人员，接受街道办事处（乡镇政府）和区综合行政执法部门的检查。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; text-align: left; caret-color: transparent;"><span style="font-size: 17px;">第十条 </span></strong><span style="text-indent: 2em; text-align: left; caret-color: transparent; font-size: 17px;">市城管执法部门定期协调公安机关交通管理部门开展联合执法检查。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; text-align: left; caret-color: transparent;"><span style="font-size: 17px;">第十一条</span></strong><span style="text-align: left; caret-color: transparent; text-indent: 2em; font-size: 17px;"> “门前五包”责任制工作成绩突出的临街单位和商户，由市、区政府（管委会）按照国家、省有关规定表扬奖励。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; text-align: left; caret-color: transparent;"><span style="font-size: 17px;">第十二条</span></strong><span style="text-align: left; caret-color: transparent; text-indent: 2em; font-size: 17px;"> 临街单位、商户违反本规定、不履行“门前五包”义务的，由有关执法部门依据《邯郸市城市市容和环境卫生条例》等予以处罚。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; text-align: left; caret-color: transparent;"><span style="font-size: 17px;">第十三条 </span></strong><span style="text-align: left; caret-color: transparent; text-indent: 2em; font-size: 17px;">对侮辱、谩骂“门前五包”行政管理人员、行政执法人员及阻挠执行公务，构成违反治安管理行为的，由公安机关依法处理；构成犯罪的，依法追究刑事责任。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; text-align: left; caret-color: transparent;"><span style="font-size: 17px;">第十四条</span></strong><span style="text-align: left; caret-color: transparent; text-indent: 2em; font-size: 17px;"> 有关工作人员玩忽职守、滥用职权、徇私舞弊的，依据有关法律法规追究责任；构成犯罪的，依法追究刑事责任。</span></p><p style="text-align: justify; margin-top: 8px; margin-bottom: 8px; text-indent: 2em;"><strong style="text-indent: 2em; text-align: left; caret-color: transparent;"><span style="font-size: 17px;">第十五条</span></strong><span style="text-align: left; caret-color: transparent; text-indent: 2em; font-size: 17px;"> 其他县（市、区）政府（管委会）可参照本办法执行。</span></p><p style="text-align: justify;
